Terms and Conditions

The following terms and conditions are in place to ensure we maintain a safe and fair online Axiom Training ecommerce website and terms of trade for our customers.

Axiom training is the trading name of AMS Group Ltd.

Acceptance of Terms and Conditions

As a user, course registrant (paid, direct credit or on account) or submitter online form on the Axiom Training website (axiomtraining.co.nz), or engage Axiom Training to deliver services, you accept these terms and conditions.  Should you choose not to accept these terms and conditions, you are not permitted to use the Axiom Training website or purchase services from this website.

These Terms and Conditions have the following expressions and meanings:

  • 'Service', 'Services' means any service that is provided by the Axiom Training website including training courses;
  • 'We' and 'Us' and 'Our' are reference to Axiom Training;
  • 'You' and 'Your' are reference to users and/or browsers of the Axiom Training website;
  • 'Website' means the Axiom Training website axiomtraining.co.nz;
  • 'Product' means any product or training service or course that is offered for registration, sale and/or purchase on the Axiom Training website;
  • 'Customer', ‘Customers’ includes any person buying or registering for a service on the Axiom Training website;

Changes to Terms and Conditions

These terms and conditions may be changed from time to time.  All changes will be effective immediately upon posting changes on the website.  It is the responsibility of all Axiom Training customers to be familiar with the latest terms and conditions. Your on-going use of the Axiom Training website represents your agreement to these terms and conditions.

Service Guarantees

Axiom Training ‘s provision of services are covered under the Consumer Guarantees Act. Axiom Training provides training services with reasonable care and responsibility and with skill, fit for purpose.

Your rights for service provision and supply of service are covered under legislation. More information can be provided by the Ministry of Consumer Affairs.

Your Information

As a user of the Axiom Training website you warrant that you have provided complete, accurate and current personal or business information. Axiom Training may phone or mail you to verify these details.  Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of services through the Axiom Training website. 

Course Schedule

The course schedule published on the website is subject to change without notice.  New courses are added and will show public course dates, at minimum, 1 month in advance.

Courses are updated as information comes to hand including the availability of spaces. While every effort is made to ensure that errors are omitted these may arise from time to time.

If information on the website is incorrect, registrants will be contacted and alternative options discussed.

Price

All prices shown on the website are subject to change without notice.

All prices published on the Axiom Training website are in New Zealand dollars and exclude 15% Goods and Services Tax (GST) where stipulated.  Courier fees are not applicable to course material unless otherwise stated.

Costs are broken down on each course to reflect the following:

  • Course Cost: The cost to deliver the course as per the specified terms on the course information pages.
  • Credit Registration: Any additional costs associated with the course to register NZQA Credits.  This is specified with each course and again in the registration summary page and confirmation of registration.  Please refer to the NZQA Credit Registration section below for more information.

NZQA Credit Registration

As an NZQA accredited Private Training establishment (PTE) Provider Number 7252. AMS Group registers NZQA Credits on behalf of the Student. NZQA credit registration is compulsory.

NZQA Credits are based on the credits available on a specified unit standard completed as part of a course.  These credits are added to your record of learning held by NZQA.  These are your credits and support your evidence of completion of unit standards and qualifications. There is a cost to deliver the course, register the credits and administer the registration of credits.  Direct costs from NZTA are passed on through the specified credit cost.

Where a course is specified as “Any Credit Cost Included” the course has:

  1. No credits to register with NZTA or
  2. Credits applicable to the course are included in the cost of the programme and will be automatically registered on behalf of the Student.

Where to find the Credit Costs

Where a course has NZQA Credits associated with the delivery of unit standards as specified, the course credits and the cost of the credits is specified with each course information page and again in the registration summary page and on confirmation of registration. This is separated for transparency of cost, but is a compulsory requirement for any course where NZQA Unit Standards are being delivered and specified as a cost.

National Qualification Awards

Axiom Training can award the following National Qualifications:

  1. Certificate in Road Transport

Where Axiom Training is accredited by NZQA to assess only the unit standards associated with a National Certificate programme, Axiom Training will apply to NZQA for the award of the qualification.

Confirmation of Order / Course Registration 

All customers will receive a confirmation of their registration via e-mail when payment is received, direct credit requested or on account selected for registration of a course the Axiom Training website. Customers, following a credit card payment, will also receive an invoice with their order.

  1. Online Payment through the website 
  2. Direct Credit
  3. On Account

The automated receipt of registration from the website is not a confirmation of acceptance on a course. Registration is not confirmed until payment has been made and prerequisite required (if any) are verified, account terms met and a confirmation letter is received. (Sent Via email).

A contact form submitted, onsite request form submitted or an email request sent is not a course registration.

Attendee Numbers

Where you are making a booking that includes more than one attendee or booking a course on site minimum numbers of attendees, if the number attending changes:

  1. An increase in attendees will be charged in accordance with the registration costs (advertised or agreed)
  2. A reduction of the numbers of attendee’s is subject to our cancellation policy or minimum number requirements.

Where more attendees are registered for an onsite course than booked, the invoice will be adjusted to reflect the increase in numbers or if paid in advance a 7-day invoice provided.

Payment Terms

Payment terms are strictly pay prior to the course date, except where a commercial account has been approved, payment is then required 20th of the month following the date of the course.

Axiom Training has a number of convenient payment options for customers.

Online Payment

We accept payment for purchases made through the Axiom Training website via Visa and Master Card credit cards only. All charges are made in New Zealand dollars and include GST.  We charge your credit card at the time of your purchase via the DPS secure payment system. This is a secure payment gateway through DPS and security certificate verified for your protection. Payment details will appear on your statement from AMS Group Ltd

Direct Credit

By registering for a course using the direct credit option, course registration will remain a request only until registration is made.  For popular courses it is recommended that payment is made promptly as paid registrations will be given priority.

On Account

To enable a payment on account, you must have a credit account with Axiom Training accepted prior to the registration of a course.  If you register for a course on account, without a verified account number your course registration will remain a request only until full payment is received.  Once full payment is received, the registration will be confirmed.

Account holders will be invoiced prior to the delivery of the course and payment terms and prices are based on prior arrangements with management.

Please contact Axiom Training if you wish to apply for a credit account. Please do not be offended if this is not made available to you.

Cheque Fee

A cheque processing fee of $0.50 will need to be added to the total cost of your account if you are paying by business cheque.  Personal cheques are not accepted by Axiom Training.

Cancellation Policy

Axiom Training operates a strict Postponement and Cancellation policy.

Notice of this cancellation or request for postponement must be made in writing to office@axiomtraining.co.nz 5 working days prior to the commencement date of the course.

The following cancellation fees will apply:

  1. Less than 2 working days’ notice given – 100% of quoted course fee will be charged.
  2. Between 3 – 5 working days’ notice given – 50% of the quoted course fee will be charged.
  3. More than 5 working days' notice given – no charge.

Please be advised should any circumstance arise (including poor health conditions) that would prevent attendance on the course trainees are encouraged to rebook training for a later date. For any cancelled bookings our above cancellation fees will apply.

Axiom Training Directed Course Cancellation Policy

From time to time Axiom Training will need to reschedule a course or cancel a course.  This may be due to trainer availability (sickness bereavement etc), venue availability or low course attendance for example. Axiom Training will endeavour to deliver the course in the first instance with course cancellation a last resort.

While we do our very best to provide a minimum of 48 hours’ notice, from time to time the notice may be as little as 24 hours. We will arrange for an alternative time and date for attendance and where you are not able to attend a full refund or payments for the course is provided.

Attendance

Where a start time for a training course is provided, this is the actual start time. Times are given to ensure that the learning required for the course can be delivered in the time specified.

Axiom Training Trainers have the right to refuse entry to any attendee to a course that is already underway and the standard cancellation policy applies (see cancellation policy above).

Course Pre-Requisites

There are minimum pre-requisites for Axiom Training courses.  These are specified on the information pages. 

The standard pre-requisites for each course are available on the course information sheets, website and are specified on your course confirmation letter.

Standard Pre-requisite for all Axiom Training courses required to meet NZQA specifications:

  • Applicants must be 16 years of age or over
  • Applicants for whom English is a second language must meet IELTS (or equivalent) Level 5.0 (General Training). Proof of this will be required

More specifically trainees will need to be able to perform the following:

Literacy and Numeracy Course Requirements

Axiom Training training courses will require learners to be able to:

  • Read training, assessment and workplace documentation that contains specialised and academic language (e.g. Course Study Guide, PowerPoint presentation, Assessment Task Booklet, organisation policies and procedures, workplace signs and symbols, relevant legislation)
  • Complete forms and write short sentences
  • Listen to and respond to spoken instructions
  • Participate in conversations using specialised language

English Language Requirements

The skills and knowledge trained will be assessed against national recognised competency standards.  This is the highest level of assessment and demands assessment candidates to prove their competency against all criteria in the national standard.  In order to verify competency, participants must have English language skills that are sufficient for them to actively participate in the course. 

For people who do not have English as their first language, the level of English language skills required is equivalent to an International English Language Testing System (IELTS) score of 5.0 (General Training) or equivalent. Evidence of this may be required if the trainer is not confident of their English language.

Reader/Writer and Translation Requirements

Not all courses are eligible for reader writer or translator assistance, this is due to some courses requiring the trainee to communicate written and verbally to a standard that can be understood by others. If you require assistance you need to contact Axiom Training directly to confirm eligibility, before booking a course.

A Note on Booking on Behalf of the Trainee

If you are making an online booking on behalf of someone then you agree that all pre-requisite conditions are met including all minimum pore-requisites and by agreeing to these terms and conditions, as responsible for providing proof of eligibility of a trainee to attend a course.

Important: Where Pre-requisites Are Not Met

If it is determined by the Trainer or other Axiom Training staff that the trainee attending the course does not meet the stated pre-requisite for the course, then standard cancellation policies will apply.

  1. Where notice is given less than 5 working days and 2 working days before the course start date, 50% of the total course fee is refundable.
  2. Any postponements or cancellations given with less than 2 working days’ notice will result in full course fees (100%) being charged.

The trainee will be refused training on the day and will not be able to be rebooked until the pre-requisite criteria has been met and proof has been provided. 

Course Materials and Required Reading

Course material will contain pre-course reading and in some instances course assessments.  Please ensure that and any assessment is completed prior to the course start.  This is to ensure You have sufficient knowledge and will be able to complete the required assessments.

Company

It is the responsibility of the purchaser of the service to distribute the learning material to the course attendee’s prior to the delivery of the course, in a time frame to allow attendee’s to complete the required reading and pre-learn assessments.  Courses that include required reading and / or assessment are specified in the confirmation letters.

Individual

Once you have paid for your course you will be sent course material. 

Course Numbers

Course numbers are specified as a minimum and a maximum on the information pages to enable the delivery of a course.

  • Minimum: Number of attendees required to ensure the delivery of a course.
  • Maximum: A strict number of attendees as specified in industry standards for a delivery of a particular programme or Units Standard.  This can also be in consideration of safety of trainers and attendees. Axiom Training will NOT allow additional attendee’s where a maximum is shown.

Trainers

Axiom Training’s policy is to provide only the best trainers with industry expertise and experience.  Trainers are both employees of Axiom Training or Contractors to Axiom Training.  Your course could be delivered by either. Contractors are representatives of Axiom Training, are delivering Axiom Training approved course material and are subject to the same moderations and assessments of their training as employees, to ensure quality of delivery.

Emails, Newsletters and Reminders

Axiom Training may send you emails relating to products purchased, transactions and other activities on the website, and for promoting and marketing other Axiom Training product and services to you including new courses, notifications or specials on offer.  Axiom Training may also send regular electronic newsletters to customers.  Newsletters will contain clear and obvious instructions on how you can unsubscribe from the mailing list.  If you do not wish to receive these electronic emails, please contact us to have your name removed.  Where a course requires a refresher is completed in the future, these will be notified to you directly via mail, email, txt or phone.

Indemnity

Except where we have expressly accepted responsibility to you under these Terms, you will keep us protected against any legal action taken against us and pay us any costs, losses or expenses we incur in connection with your use of our website or any failure by you to comply with these Terms.

Termination

We reserve the sole discretion, without notice, to terminate your account and ability to use Axiom Training services or use our website services, if we believe that you have breached these Terms and Conditions.  We may also in our sole discretion and without notice to You, stop providing some or all of the product and/or services or the Axiom Training website as a whole.  Any termination by Us under this term will not affect any rights or responsibilities which are intended to continue, or come into force after that time.

Intellectual Property Rights

Axiom Training (and Axiom Training suppliers as the case may be) own all proprietary and intellectual property rights on and in the Axiom Training website (including text, content, graphics, logos, images, icons) and the software and architecture forming Axiom Training product, services and the website.  You may not without our prior written permission, in any form or by any means copy, reproduce, adapt, display, distribute, publish or create derivative works from any part of the Axiom Training website; or commercialise, copy, or on-sell any information, or items obtained from any part of the Axiom Training website.

Disclaimer

Every effort is made to ensure that the information contained in this website is accurate to the best of Axiom Training’s knowledge. Nothing on this website constitutes, or is meant to constitute, advice of any kind.  If you require advice in relation to any legal, financial or medical matter you should consult an appropriate professional.

Axiom Training makes no representations or warranties, either expressed or implied, as to the accuracy of the information on this website, or its fitness for any purpose whatsoever. General Terms

In the event of a dispute arising in relation to these Terms and Conditions, the New Zealand courts will have non-exclusive jurisdiction over such a dispute. If we do not exercise or enforce any right available to us under these Terms, this does not constitute a waiver by us of those rights. We may transfer this agreement or any benefit or obligation of this agreement to any person without notice to you.  You may not transfer any benefit or obligation to any other person without our written consent.  Each part of these Terms is separately binding.  If for any reason any part cannot be relied on, all other parts remain binding.

Privacy Act 1993

If you are an individual, you have rights under the Privacy Act 1993 to access information held by us, and to request the correction of such personal information. In respect of such personal information, You:

  • Authorise Us to obtain personal information about You, via Your Registration Form and Your use of Axiom Training and Our Services.
  • Authorise Us to use Your personal information for direct marketing and promotional activities, research and development purposes, identity verification, and otherwise in respect of the provision of Our Services to You.
  • Agree that further notification to You of the purpose of the collection of Your personal information is unnecessary and non-compliance with the requirements of Principle 3 of the Privacy Act 1993 is authorised.
